1. Eligibility

The App is intended for users aged 13 and older. By using the App, you represent that you are at least 13 years of age. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts of users who do not meet these eligibility requirements.

2. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your login credentials confidential and secure.
• Accept responsibility for all activities that occur under your account.

You must notify us immediately at support@height.fit if you suspect unauthorized use of your account.

3. Use of the App

HEIGHT grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes subject to these Terms. You agree not to:

• Copy, modify, distribute, or create derivative works based on the App.
• Reverse engineer, decompile, or disassemble the App.
• Use the App for any unlawful or unauthorized purpose.
• Interfere with or disrupt the App’s infrastructure or security features.
• Use automated systems (bots, scrapers) to access the App.
• Share, sell, or transfer your account to another person.

4. Subscriptions and Payments

Some features of the App require a paid subscription. By purchasing a subscription:

• You agree to pay all applicable fees as described at the time of purchase.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Payments are processed through Apple App Store or Google Play Store and are subject to their respective terms.
• Refunds are handled according to the policies of the respective app store.

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, algorithms, software, and the HEIGHT brand — are the exclusive property of Heightfit, Inc and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from the App without our prior written permission.

7. User Content

By submitting content to the App (including photos, measurements, and scan data), you grant Heightfit, Inc a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content solely for the purpose of providing and improving our services. You retain ownership of your content and may request its deletion at any time.

8. Disclaimers

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. We do not guarantee that:

• The App will be available at all times or free from errors.
• Height predictions or growth projections will be accurate.
• Use of the App will result in any specific height increase.
• The App will meet your specific requirements or expectations.

9. Limitation of Liability

To the maximum extent permitted by law, Heightfit, Inc and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to physical injury, loss of data, or loss of revenue, whether based on warranty, contract, tort, or any other legal theory.

10. Indemnification

You agree to indemnify and hold harmless Heightfit, Inc and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App and updating the “Last Updated” date. Continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
